Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the http://consider.ie website (the "Service") operated by Consider.ie. Your access to and use of the Websites and Services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service. By accessing or using the Websites and Services you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Websites and Services.
1. LINKS TO OTHER WEBSITES
Our Websites and Services contains links to third-party web sites or services that are not owned or controlled by Consider.ie. Consider.ie has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Consider.ie shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.
2. CHILDREN'S PRIVACY
Consider.ie is committed to protecting the privacy needs of children. Only persons who are more than 18 years-old may use our Websites and Services. By accessing our Websites and Services, you are legally acknowledging that you are over the age of 18. If you are under the age of 18, you don't have the legal right to access our Websites and Services.
We have implemented industry-standard security safeguards designed to protect the personal information that you may provide. We also periodically monitor our system for possible vulnerabilities and attacks, consistent with industry standards. You should be aware, however, that since the Internet is not a 100% secure environment, it's your responsibility to protect the security and integrity of your account details, including your username and password (when the registration feature is made available at a future stage). If you become aware of any security breach of your password or of the security of the Websites or Services, you must alert us as soon as possible using the contact details at the end of this document.
We may terminate or suspend access to our Websites and Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
5. GOVERNING LAW
Consider.ie is a new aggregator website (i.e. a site consisting of news links to other sites). Although the domain name and the location of website development of this site is in Ireland, the website data is stored in the USA. Consider.ie uses "OG" meta data content retrieved from websites using a web crawler. This web crawler respects the robots.txt file on each site and only accesses areas which the site owner has identified as open to web crawlers. The link, title, summary and image links which we employ to create this site, are used under the 'fair use" rules in the USA (where the website crawling processing occurs and our database of links is hosted), which does not contravene copyright of the content owners. We are merely providing a service to link to the content on the source sites and we also provide information to clearly identify where the content was sourced and do not claim any ownership of the content. If any website owner feels that they are unhappy with our use of this "fair use" content, please contact us and we will immediately remove any information which relates to your site. Other than the metadata described above, we do not store any other information from the source websites, nor do we sell the information to anyone else.
Any action or proceeding arising out of, or related to the Websites or Services must be brought in Ireland, where this site has been developed and is maintained, and you consent to the exclusive personal jurisdiction and venue of such courts. Any cause of action you may have with respect to the Websites or Services must be commenced within one year after the claim or cause of action arises.
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 15 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Websites and Services after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Websites and Services.
